1. Who these terms are between

These terms are between you and Loading Growth Pty Ltd, Brookvale NSW, Australia ("Loading Growth", "we", "us"). By using this site, the scorecard or any Loading Growth program you agree to them. Paid programs also have a program agreement, which prevails if the two conflict.

2. Eligibility and accounts

You must be at least 18 and acting for a business. Information you give us must be accurate and kept current. You are responsible for keeping any passwords secure and for activity under your account.

3. Acceptable use

Use the site lawfully. Do not post or send unlawful, defamatory or harmful content, collect other people's personal information, interfere with the site's operation, or introduce malicious code.

4. Intellectual property

Everything on this site and in our programs, including the Loading Growth Wheel, the Nine Keys and 88 levers, The EBIT Dial, the Role Reset Framework, the 90 Day Sprint, the scorecard, templates, playbooks, videos and session recordings, is owned by Loading Growth or its licensors and is protected by copyright and other laws. You may use program materials inside your own firm for the purpose they were provided. You may not copy, publish, resell, sublicense, train models on, or otherwise commercially exploit them without our written consent.

5. Confidentiality

Coaching sessions and communities work because founders speak openly. You agree to keep confidential anything you learn about other members' businesses, and we will keep confidential what you share with us, except where disclosure is required by law.

6. Programs, payments and refunds

Fees, billing frequency, term and cancellation for each program are set out in its program agreement or at the point of purchase. Fees are in Australian dollars and exclude GST unless stated. Everest Basecamp is billed monthly and can be cancelled before the next billing date. Nothing in these terms limits your rights under the Australian Consumer Law.

7. No guaranteed results

Our programs are business coaching and education. Results depend on your firm, your market and the work you put in. Case studies, exit values and client outcomes on this site are real and specific to those firms, and are not a promise of what you will achieve. Nothing we provide is legal, accounting, tax or financial advice.

8. Liability

To the extent permitted by law, the site and programs are provided as is and we exclude all implied warranties. Where a guarantee cannot be excluded under the Australian Consumer Law, our liability is limited to resupplying the service or paying the cost of resupply. We are not liable for indirect or consequential loss, including loss of profit.

9. Termination

We may suspend or end your access to the site or a program if you breach these terms, a program agreement or the law. Sections 4, 5, 7 and 8 survive termination.

10. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of its courts.

11. General

You may not transfer your rights under these terms. If any part is unenforceable the rest stands. These terms, the privacy policy and any program agreement are the entire agreement between us. We may update these terms by posting a new version here, and continued use means acceptance.
